What is Pretrial Diversion
Diversion has been created to divert youth and adults from their encounters with the Court System and to prevent the individual from having future encounters with law enforcement and the Court. Diversion is intended for first-time offenders, but may be extended to individuals with past offenses based on the discretion of the County Attorney.
Individuals are diverted before any contact with the Court. Individuals are referred to Pretrial Diversion by the Seward County Attorney who determines the eligibility of the alleged offender or individuals may request Diversion by contacting the County Attorney at 402-643-2795. Individuals participate in these programs voluntarily before prosecution and do no admit guilt.
The Pretrial Diversion Coordinator will develop an agreement that contains requirements for the individual to complete. Once these requirements are completed, the charges are dismissed by the County Attorney.
If individuals do no complete their pretrial diversion program successfully, their case is referred to the County Attorney.
