A regular meeting of the Seward County Commissioners was convened in open and public session at 9:00 a.m. on October 9, 2007 in the Commissioner’s room at the Seward County Courthouse.  Notice of the meeting was posted on the Courthouse bulleting board and on the Commissioner’s room door.  The agenda for all meetings is kept continually current and is available for public inspection at the County Clerk’s Office during normal business hours.  The agenda is held open until one business day prior to the meeting for appearance before the Board.  The Board of Commissioners has the right to modify the agenda to include items of an emergency nature only at such public meeting.

The Chairman noted that the public meeting information is posted as required by law and available for public distribution if requested.

 

The Pledge of Allegiance was recited.

 

Sherry Schweitzer, Seward County Clerk and member of the Committee to Appoint a Commissioner to fill the vacancy in the 4th District, announced that the Committee had met at 8:00 a.m. this morning, as published in the newspaper, and appointed Larry Dedic as County Commissioner for the 4th District.  The vacancy was created due to the resignation of the Ron Minchow.

 

The Commissioners recessed at 9:03 a.m. to view the swearing in ceremony of Larry Dedic in the District Courtroom.

The Commissioners reconvened at 9:11 a.m.

 

Commissioner Larry Dedic is now present as the Seward County Commissioner representing the 4th Commissioner District of Seward County.

 

Moved by Koci and seconded by Stuhr to approve the minutes of October 2, 2007.

Affirmative vote: Koci, Stuhr, Miller, Dedic, Ruzicka                        Motion Carried.

 

Gary Petersen, Seward County Emergency Manager asked the Commissioners about the 911 Signage.  He asked the Commissioners about size, type, color, etc. of the signs.  He also informed the Commissioners about an Emergency Management exercise in January.

 

Commissioner Reports:

Commissioner Miller had no report

 

Commissioner Stuhr reported he had received many calls concerning the RFP for architectural services for a jail project.

 

Commissioner Dedic had no report.

 

Commissioner Koci had no report.

 

Commissioner Ruzicka had no report.

 

Moved by Koci and seconded by Stuhr to adopt Resolution #2584 in regard to a YIELD sign being erected at the NE corner of the NE ¼ of Section 2, Township 12 North, Range 4 East of the 6th p.m. for eastbound traffic.

RESOLUTION NO. 2584 OF THE SEWARD COUNTY BOARD OF COMMISSIONERS

 WHEREAS, in the judgment of the Seward County Board of Commissioners, it is deemed advisable and public safety demands that a YIELD sign be erected and maintained at the following location:

Located at the intersection of the NE ¼ of the Northeast corner of Section 2, Township 12 North, Range 2 East, installing a YIELD sign for Eastbound traffic

THEREFORE BE IT RESOLVED, that a YIELD sign be erected at this location.

Moved by Koci and seconded by Stuhr to adopt Resolution #2585 in regard to the striking of certain personal property taxes off the tax roll.

RESOLUTION NO. 2585 OF THE SEWARD COUNTY BOARD OF COMMISSIONERS

Whereas: As stated in the distress warrant report presented to this Board earlier this year, it was recommended by the Seward County Treasurer to strike some personal property taxes.

 

After consultation with the Seward County Attorney, it is recommended to strike the below, as per statute Section 77-1838, which states the County Board can do after the issuance of said warrant for two consecutive years:

 

Therefore, Let It Be Resolved this County Board directs the Seward County Treasurer to strike the below personal taxes.

Gary Petersen then spoke to the Board about a Mitigation Planning Grant and presented documents to the Commissioners for their signature.

 

Moved by Stuhr and seconded by Koci to authorize the Chairman to sign the Mitigation Planning Grant Award Document.

Moved by Ruzicka and seconded by Miller to adopt Resolution #2586 in regard to setting levies for the various entities of Seward County.

RESOLUTION NO. 2586 OF THE SEWARD COUNTY BOARD OF EQUALIZATION

WHEREAS, Pursuant to State Statute 77-1601, each County Board of Equalization shall, each year, on or before the 15th of October levy the necessary taxes for the current year if within the limit of the law, AND,

 

WHEREAS, These levies shall include the amounts for operations of county government and shall also include all levies necessary to fund tax requests certified and authorized as provided in sections 77-3442 to 77-3444.

 

NOW, THEREFORE, BE IT RESOLVED: That the Seward County Board of Equalization hereby levies the taxes as requested and certified, for the various political subdivisions as set forth in Exhibit A attached and incorporated by reference herein.
