Seward County Board of Equalization

A regular meeting of the Seward County Board of Equalization was convened in open and public session at 8:30 a.m. on October 27, 2009 in the Commissioner’s room at the Seward County Courthouse.  Notice of the meeting was posted on the Courthouse bulletin board and on the Commissioner’s room door.  The agenda for all meetings is kept continually current and is available for public inspection at the County Clerk’s Office during normal business hours.  The agenda is held open until one business day prior to the meeting for appearance before the Board.  The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.

Moved by Stuhr and seconded by Miller to approve the minutes of October 13, 2009.

Moved by Miller and seconded by Koci to approve Tax List Corrections 65-08R & 66-08R.

Affirmative vote: Miller, Koci, Garske, Stuhr, Dedic                         Motion Carried.

 

Moved by Stuhr and seconded by Garske to approve the County Board of Equalization change of value notice for NE Colorado Cellular Inc.

Affirmative vote: Stuhr, Garske, Koci, Miller, Dedic                         Motion Carried. 

 

Moved by Miller and seconded by Koci to open a Public Hearing at 8:37 a.m. to re-set the Pleasant Dale levy.

Affirmative vote: Miller, Koci, Garske, Stuhr, Dedic                         Motion Carried. 

 

Schweitzer then explained the process when a political subdivision, such as the Village of Pleasant Dale, does not have the appropriate hearing at budget time and the necessary steps the County Board of Equalization has to take to set a levy according to the budget they filed.

 

No one appeared to support or oppose said re-setting of levy. 

 

Moved by Miller and seconded by Koci to close the public hearing at 8:41 a.m.

Moved by Koci and seconded by Garske to adopt Resolution #2749 in regard to the re-setting of the Village of Pleasant Dale levy.

Resolution 2479 of the Seward County Board of Equalization

WHEREAS,   Pursuant to State Statute 77-1601, each County Board of Equalization shall, each year, on or before the 15th of October levy the necessary taxes for the current year if within the limit of the law, AND,

 

WHEREAS, These levies shall include the amounts for operations of county government and shall also include all levies necessary to fund tax requests certified and authorized as provided in sections 77-3442 to 77-3444, AND

 

WHEREAS, The Village of Pleasant Dale had a clerical error due to lack of sufficient documentation of their hearing to “Set the Tax Request Different than the Prior Year,” which has now been submitted, AND

 

WHEREAS, The Seward County Board of Equalization already set the levy for the Village of

Pleasant Dale on October 13, 2009 prior to the submission of the documentation, AND

 

WHEREAS, State Statute 77-1601 allows for a correction of levy in the case of a clerical error, AND,

 

WHEREAS, It is in the best interest to correct the levy of the Village of Pleasant Dale due to

their clerical error.

 

NOW, THEREFORE, BE IT RESOLVED:  That the Seward County Board of Equalization hereby corrects the levy of the Village of Pleasant Dale and levies the taxes as requested and certifies as follows:

Village of Pleasant Dale: 

General Fund levy:  .350436

Street Fund levy:    .049564

During public/officials/board discussion, Russ Daehling, Seward County Highway Superintendent reported that the SENDD representative in charge of the Seward Isaak Walton Road Project might change.  He reported on road grader machine repairs, road maintenance and also stated that NIRMA would have a loss prevention day at the road department.

 

Terry Kamprath, Jail Administrator reported on employee updates and prisoner census.

 

Gary Peterson gave the Commissioners their copy of the new LEOP (Local Emergency Operation Plan).

Commissioner Reports:

Commissioner Stuhr reported he attended a jail facilities meeting, personnel board meeting, Planning & Zoning Commission meeting and met with the County Attorney on the Conditional Use permit procedures in regard to a recent request.

 

Commissioner Garske reported she is working with CASA on some upcoming events and will attend an Economic Development meeting this evening.

 

Commissioner Dedic reported that he also attended a jail facilities meeting, a Blue Valley Community Action meeting, had received phone calls in regard to road concerns, and reported that a Saline County Commissioner had been recently killed.

 

Commissioner Koci reported she had been involved with the replacement of a SENDD employee.

 

Commissioner Miller had no report.

 

Moved by Stuhr and seconded by Dedic to approve the right of way request from TransCanada Keystone Pipeline between Sections 20 & 17, Township 9 North, Range 3 East of the 6th p.m.

Moved by Stuhr and seconded by Koci to approve the right of way request from TransCanada Keystone Pipeline between Sections 31, Township 12 North, and Section 6, Township 11 North, all in Range 3 East of the 6th p.m.

Moved by Garske and seconded by Stuhr to authorize the Chairman to sign the Certification of Cost Allocation Plan with Maximus.

Jamie Hopp, Deputy County Attorney, was present in regard to security at the courthouse.  She gave the Board estimates on several security options and also stated that a grant could be applied for from NIRMA, our insurance carrier. 

 

Moved by Stuhr and seconded by Koci to authorize the Chairman to sign the grant application for courthouse security from NIRMA ASSIST.

Moved by Stuhr and seconded by Dedic to open bids at 9:30 a.m. for a generator.

Bids were received from ABC Electric, Oswald Electric & Gene’s Electric.  The awarding or rejection of a bid will be on the agenda for November 3, 2009.

 

Commissioner Stuhr led discussion on the Conditional Use Permit process for the off-road motorcycle facility in Section 23, Township 10 North, Range 3 East of the 6th p.m., and stated that the County Attorney’s recommendation would be to remand it back to the Planning & Zoning Commission to give reasons for approval.  Stuhr stated that reasons are required by Zoning Regulations.  The permit request should then come back to Board of Commissioners for a decision.  Stuhr’s understanding is that if any new information is presented to the Board of Commissioners, a new hearing should take place.  The Planning & Zoning Commission is comfortable with information presented at their meeting. 

 

Moved by Garske and seconded by Dedic to remand the Conditional Use Permit request for an off-site motorcycle facility in Section 23 Township 10 North, Range 3 East of the 6th p.m. to the Planning & Zoning Board for findings of fact.

The Commissioners recessed at 9:47 a.m.

Commissioner Koci presented the name of Kathy Cast for the Extension Board.

 

Moved by Koci and seconded by Stuhr to appoint Kathy Cast as a member of the Extension Board.

Moved by Stuhr and seconded by Garske to accept the Treasurer’s 1st Quarter Investment Report for fiscal year 2009-2010.

Moved by Koci and seconded by Stuhr to adopt Resolution #2750 in regard to the Certification of Distress Warrants.

RESOLUTION #2750 OF THE SEWARD COUNTY BOARD OF COMMISSIONERS

WHEREAS: The Seward County Treasurer submitted the Certification of Distress warrants to be collected for the Tax Year 2008 in a timely manner.

 

THEREFORE this Seward County Board accepts the certification of the warrants to be collected by the County Sheriff for the above tax year.
