Seward County Board of Equalization

A regular meeting of the Seward County Board of Equalization was convened in open and public session at 8:30 a.m. on December 8, 2009 in the Commissioner’s room at the Seward County Courthouse.  Notice of the meeting was posted on the Courthouse bulletin board and on the Commissioner’s room door.  The agenda for all meetings is kept continually current and is available for public inspection at the County Clerk’s Office during normal business hours.  The agenda is held open until one business day prior to the meeting for appearance before the Board.  The Board of Equalization has the right to modify the agenda to include items of an emergency nature only at such public meeting.

Marilyn Hladky was present to discuss a letter to the Property Tax Administrator with regard to analysis of agricultural land. 

 

Moved by Miller and seconded by Koci to approve a letter to the Property Tax Administrator with one change that the letter is from the Chairman of the Board of Equalization.

Seth with Nebraska Machinery was present to discuss a skid load lease agreement for 2010.

 

 

Commissioners Reports:

Commissioner Stuhr had no report.

 

Commissioner Garske reported that she attended the swearing in of CASA advocates.

 

Commissioner Dedic reported that he met with Commissioner Koci and the County Attorney to brain storm on office space.

 

Commissioner Koci reported also that she met with Commissioner Dedic and the County Attorney regarding office space.

 

Commissioner Miller had no report.

 

The 3rd Floor Air Quality was discussed. Jacque Stewart, Clerk of the District Court and Sheila Beins, County Court Clerk were present.

Commissioner Garske reported that Chris Reed from the Nebraska Safety Council presented a bid in the amount of about $1300.00 to do testing on the District Court Office. Testing the whole Courthouse was then suggested.  Commissioner Garske will speak with Chris Reed from the Nebraska Safety Council to get a bid on the whole Courthouse and then get back to the Board at a later date.

 

The Commissioners recessed at 10:00 a.m.

The Commissioners reconvened at 10:10 a.m.

 

Don Stockley and Matt Howe with Technical Services Inc. were present to discuss the Anti-virus subscription that is up for renewal.  They presented the Commissioners with 2 options, Symantec anti virus would cost approximately $2,200.00 and Comodo would cost approximately $1,600.00. Technical Services Inc. will get information and report back to the Commissioners next week.

 

Moved by Stuhr and seconded by Koci to approve the Right of Way request for Seward County Rural Public Power District between Sections 32 & 29 of Township 10 North, Range 1 East of the 6th p.m.

Affirmative vote: Stuhr, Koci, Dedic, Garske, Miller                         Motion Carried.

 

Moved by Koci and seconded by Stuhr to approve the Right of Way request for Terry Hackbart in the S ½ SW ¼ of Section 9 of Township 10 North, Range 3 East of the 6th p.m.

Affirmative vote: Koci, Stuhr, Garske, Dedic, Miller                         Motion Carried.

 

Moved by Dedic and seconded by Koci to approve the Right of Way request for Seward County Rural Public Power District between the NE ¼ of Section 27, the NW ¼ of Section 26 and the SW ¼ of Section 23 all in Township 12 North, Range 1 East of the 6th p.m.

Affirmative vote: Dedic, Koci, Stuhr, Garske, Miller                         Motion Carried.

 

Moved by Stuhr and seconded by Garske to accept the Clerk of the District Court fee report for November 2009 in the amount of $1,248.70.

Affirmative vote: Stuhr, Garske, Koci, Dedic, Miller                         Motion Carried.

 

Moved by Koci and seconded by Dedic to accept the Sheriff fee & mileage reports for October 2009 in the amounts of $2,368.50 and $1,079.58.

Affirmative vote: Koci, Dedic, Garske, Stuhr, Miller                         Motion Carried.

 

Moved by Garske and seconded by Dedic to accept the County Clerk fee report for November 2009 in the amount of $26,156.50.

Discussion was held at this time regarding trapping in County Right of Way.  County Attorney Wendy Elston presented the Commissioners with a possible Resolution to be passed for the County.

BEFORE THE BOARD OF COUNTY COMMISSIONERS

OF SEWARD COUNTY, NEBRASKA

 

IN THE MATTER OF PROHIBITING  )       

TRAPPING IN AND ALONG               )

SEWARD COUNTY ROAD                  )

RIGHT-OF-WAY                                )

 

RESOLUTION NO. 2753

 

WHEREAS, Neb. Rev. Stat. §39-1402 (Reissue 2008), provides the general supervision and control of the public roads of each county shall be vested in the county board; and

 

WHEREAS, Neb. Rev. Stat. §37-513 provides the County with the authority to adopt a resolution having the force and effect of law to prohibit the trapping of wildlife in the county road right-of-way or in a certain area of the right-of-way as designated by the county; and

 

WHEREAS, a resolution prohibiting the trapping of wildlife in the county road right-of-way is deemed necessary as an exercise of the County’s authority for the following purposes: to protect rural residents of Seward County who are routinely in and along county road right-of-way in the course of their daily activities; to protect members of the general public who have occasion to be in and along county road right-of-way in connection with their travels and other activities; to protect employees of both public and private entities (e.g. County Engineer, County Sheriff, State Patrol, State Game and Parks, Fire Departments, Ambulance Companies, Power and Water Districts, etc.), whose duties often require them to work in and along county road right-of-way; and to protect the livestock and domestic animals of rural Seward County residents.

 

NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Seward County, Nebraska, pursuant to the authority under Neb. Rev. Stat. §37-513, that trapping, as defined in Neb. Rev. Stat. §37-243 (Reissue 2008), in and along the entire width of all county

road right-of-way including roadside ditches adjacent to the traveled roadway, and beneath bridges within such county road right-of-way, is hereby expressly prohibited and declared to be unlawful.

 

BE IT FURTHER RESOLVED that all violations of the provisions of this Resolution shall be punishable as provided in Neb. Rev. Stat. §37-243 (Reissue 2008).
